At Zhang Partners, we are honored to assist you in formulating your estate wishes into a Will, assisting you in executing your estate wishes with Probate Applications and assisting your loved ones with Letters of Administrative applications.

We offer complimentary Will depository service for clients who have prepared their Will with our office. Alternatively, clients may deposit their Will at the Supreme Court Will registry for a one off fixed fee.

When should I prepare a Will?

As you soon as you have purchased a real estate property, you should consider preparing a Will.

Probate v Letter of Administration

Both are Orders from the Supreme Court giving the Applicant the authority to administer the estate. You will be applying for Probate if there is a Will and Letters of Administration if there is no Will.

How does a Will affect properties held as joint tenants?

A Will will not have the effect of severing a joint tenancy, you will need to severe the joint tenancy ownership first before the Will can have its intended effect. We will guide you through this when we prepare your Will

Will my estate go to the government or the state trustee if I do not have a Will?

If you passed away without a Will, your next in kin may apply for Letters of Administration to administer your estate in accordance with the Succession Act 2006 (NSW).

Do you intend to contest a Will?

Contesting a Will is through Supreme Court proceedings and that you are not encouraged to commence proceedings without discussing the issue with our office first.

Can I include properties located overseas?

All overseas properties should be included in your Will, however, you should note that there might be enforcement issues if properties were held in a non-Commonwealth country, in which case, you may wish to consult a foreign lawyer beforehand.

Estate Disputes / Contesting a Will

Estate Disputes are often costly and expensive as these are through Supreme Court proceedings.

You should not commence proceedings to challenge a Will unless you have completed a thorough assessment of the merits of your case. You may lodge a Caveat on the estate to prevent any further legal actions on the estate until you have more information.

Enduring Guardianship /

Enduring Power of Attorney

These are documents that must be signed in the presence of a lawyer and that the Principal and Appointor must be a state of competent mental capacity when these documents are signed. If in doubt, a medical opinion statement should be obtained.
