188A Business and Investment Visa -

Innovative Stream

s/c188A

This is a 5 year visa for successful business owners who intend to manage and operate a business in Australia.

To obtain a s/c188A:

You must be nominated by an Australian State or Territory government.

For 2 out of 4 fiscal years immediately before you receive an invitation to apply, you must have had an ownership stake in 1 or 2 businesses that had at least AUD500,000 turnover in each of those 2 years.

For your existing businesses, you must own at least:

  • 51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year

  • 30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or

  • 10%, of the total value of the business if the business is operated by a publicly listed company

Your total net business and personal assets must be at least AUD1.25 million.

Your funds must be available to transfer to Australia within 2 years of us granting the visa.

Score at least 65 on the points test and have an overall successful business career

Be under 55, unless sponsored by the State on the basis that your business will be of exceptional economic benefit to Australia.

188B Business and Investment Visa -

Investor Stream

This is a 5 year visa for Investors looking to make AUD2.5 million investments in Australia throughout the duration of their visa.

To obtain a s/c188B:

You must be nominated by an Australian State or Territory government.

Have managed a qualifying business or eligible investments:

  • a qualifying business in which you, your partner or you and your partner combined had at least 10% ownership interest, OR

  • an eligible investment of at least AUD 2.5 million owned by you.

For the 2 fiscal years immediately before application, have total assets with a net value of at least AUD2.5 million. These funds must be available for transfer to Australia within 2 years of the visa grant.

You must make a complying significant investment of at least AUD2.5 million and hold the complying significant investments continuously for the life of your provisional visa.

It must be invested in the following proportions:

  • at least AUD500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies

  • at least AUD750,000 in approved managed funds. The managed funds must invest in emerging companies listed on the Australian Stock Exchange

  • a ‘balancing investment’ of at least AUD1.25 million in managed funds

The managed funds can invest in a range of assets, including companies listed on the Australian stock exchange, Australian corporate bonds or notes, annuities and commercial real estate.

Direct investment in residential real estate is prohibited. Investment in residential property development through managed funds are also limited.

You must not use investments as security or collateral for a loan.us

Have at least 3 years' experience managing one or more qualifying businesses or eligible investments

Score at least 65 on the points test.

Be under 55 years of age.

188C Business and Investment Visa -

Significant Investor Stream

There are no age limit for this visa. This is 5 year visa for Investors willing to invest AUD5million in Australia throughout the duration of their visa.

To obtain the s/c188C:

You must be nominated by an Australian State or Territory government agency or Austrade before being invited to apply for this visa.

You must make a complying significant investment of at least AUD5 million, and have a genuine intention to hold that investment for the life of your provisional visa.

The AUD5 million must be invested in the following proportions:

  • at least AUD1 million in venture capital and growth private equity funds which invest in start-ups and small private companies

  • at least AUD1.5 million in approved managed funds. The managed funds must invest in emerging companies listed on the Australian Stock Exchange

  • a ‘balancing investment’ of at least AUD2.5 million in managed funds

The managed funds can invest in a range of assets, including companies listed on the Australian stock exchange, Australian corporate bonds or notes, annuities and commercial real estate.

Direct investment in residential real estate is prohibited. Indirect investment in residential property through managed funds is strictly limited.

You must not use investments as security or collateral for a loan.
