Employment Contracts

Australian workplace laws are largely covered by the Fair Work Act 2009 (Cth) which came into effect on 1 July 2009.

Employers should note that the Australian industrial legal framework are primarily designed at safeguarding the interests of the employees, who are seen as vulnerable parties. There are no provisions in the Fair Work Act 2009 (Cth) directed to safeguard the interests of that of the employers.

Employers must safeguard your interests through Employment Contracts or workplace policies.

Employment Contracts should cover:

  1. Post employment constraints and non-solicitation clauses.

  2. Provisions on conflicts of interest.

  3. Provisions on confidentiality and measures to maintain confidentiality post employment.

  4. Protection of all intellectual property rights including copyright and association of trademark.

  5. Payment in lieu of notice period payable by the employee.
